General Terms and Conditions of The Alpchemist

§1 Applicability to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to his or her commercial nor his or her independent professional activity (Section 13 of the German Civil Code).

§2 Formation of a contract, storage of the contract text

(1) The following provisions on the conclusion of the contract apply to orders via our online shop https://www.thealpchemist.com .

(2) In case of conclusion of the contract, the contract is concluded with

conditions.

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

Acceptance of the offer occurs in writing or in text form or by sending the ordered goods within one week. If the deadline expires without result, the offer is deemed to have been rejected.

(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.

The order is placed in the following steps:

Before bindingly submitting the order, the consumer can return to the website on which the customer's details are recorded by pressing the "Back" button in the Internet browser they are using after checking their details and correct any input errors or cancel the order process by closing the Internet browser. We will immediately confirm receipt of the order by sending an automatically generated email (confirmation of receipt). This does not constitute acceptance of the offer. Acceptance of the offer takes place in writing, in text form or by sending the ordered goods within one week.

(5) Storage of the contract text for orders via our online shop: We save the contract text and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at https://thealpchemist.com/pages/terms-of-services. You can view your past orders in our customer area under My Account --> My Orders.

§3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory sales tax and other price components. Any shipping costs are added.

(2) The consumer has the option of paying in advance, via PayPal or credit card (Visa, Mastercard, American Express).

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for dispatch immediately. Delivery will take place within 10 working days at the latest. In the case of payment in advance, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the goods sold shall pass to the buyer only when the goods are handed over to the buyer, even in the case of a sale by dispatch.

§5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

Consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You will bear the direct cost of returning the goods.

Please note that according to Section 312g Paragraph 2 No. 3 of the German Civil Code (BGB), the right of withdrawal expires prematurely for contracts for the delivery of goods that are not suitable for return for reasons of health protection or hygiene and whose seal was removed after delivery if the goods were opened after delivery. Since our products are cosmetic and hygiene products whose condition of use cannot be returned in a reusable state after opening, the right of withdrawal expires as soon as the product has been opened. We ask for your understanding.

§8 Warranty

The statutory warranty regulations apply.

§9 Contract language

As contract language german will be available exclusively.

The contracting parties agree to the application of Austrian
Legal. If the consumer has his residence or his place of business in the
habitual residence or is employed in the country, then
a lawsuit against him only establishes the jurisdiction of the court
in whose district the residence, habitual residence
or the place of employment; this does not apply to
Legal disputes that have already arisen.
